1. Acceptance of Terms

By accessing or using BriefCraft AI (the "Service"), whether through our website, web application, or API, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are entering into these Terms on behalf of an enterprise, company, or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Description of the Service

BriefCraft AI provides two offerings:

• Software subscription (Free, Starter, Professional, Agency): a cloud-hosted technical SEO tool that crawls publicly accessible web pages you submit, reports on response time, SSL/TLS, metadata, headings and sampled internal links, and generates written remediation recommendations and launch copy. Access is provisioned immediately after account registration and, for paid plans, payment confirmation.
• Done-For-You Launch Package (one-time service): after you complete our intake form, our team prepares listing copy and submits your product to the startup directories listed on our Directory page that accept third-party submissions, prepares ready-to-post kits for platforms that require the maker to post personally, and delivers a crawler-verified submission report within ten (10) business days of receiving a completed intake form.

No guarantee of third-party outcomes. Directories are independent third parties. Each directory decides on its own whether to approve a listing, how long review takes, whether links are "dofollow" or "nofollow," and whether a listing stays online. INTERSAM LLC guarantees that submissions are made as described, but does not guarantee approval, backlinks, search rankings, traffic or revenue. Fees charged by directories for paid or expedited listings are not included unless stated otherwise.

Your responsibilities for the Launch Package. You confirm that you own or are authorized to promote the product you submit, that the information and assets you provide are accurate and do not infringe third-party rights, and that you authorize INTERSAM LLC to submit them to third-party directories on your behalf.

3. User Accounts & Security

To access premium features, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information;
• Maintain the security and confidentiality of your login credentials;
• Promptly notify INTERSAM LLC of any unauthorized access or security breach;
• Accept full responsibility for all activities that occur under your account.

4. Subscription Billing, Fees & Renewal

Paid plans are billed on a subscription basis ("Subscription"). The Done-For-You Launch Package is a one-time purchase and does not renew. You agree to pay all applicable fees as listed on our pricing page:

• Billing Cycle: Subscriptions are billed in advance on a recurring monthly or annual basis depending on your selected billing term.
• Automatic Renewal: Unless cancelled prior to the end of the billing period, your subscription will automatically renew at the then-current standard rate.
• Payment Processing: Payments are processed by our payment partners, including Dodo Payments, which acts as Merchant of Record and issues receipts and invoices, and Airwallex. INTERSAM LLC never receives or stores full card numbers.
• Free Workspace: Free accounts include 3 live audits per month and are not charged. No payment details are collected for a free account.
• Price Adjustments: INTERSAM LLC reserves the right to modify subscription pricing with at least 30 days prior written notice to active subscribers.

5. Cancellation & 14-Day Money-Back Guarantee

We stand behind the quality of our service. All new subscriptions come with a 14-Day 100% Money-Back Guarantee. Launch Package refunds are governed by Section 3 of our Refund Policy.

• Refund Eligibility: If you are not satisfied with BriefCraft AI, you may submit a refund request to [email protected] within 14 calendar days of your initial purchase. Refunds are processed back to the original payment method within 5–10 business days.
• Self-Serve Cancellation: You may cancel your subscription at any time with one click from your account dashboard. Upon cancellation, your account will remain active until the conclusion of the paid billing period.

6. Intellectual Property & User Ownership

Your Content: You retain full ownership of the audit reports, remediation briefs, launch copy and listing materials generated for you through BriefCraft AI, as well as the product information and assets you provide. INTERSAM LLC claims no ownership over them.

Platform IP: The BriefCraft AI software, algorithms, user interface, brand name, trademarks, and design systems are the exclusive intellectual property of INTERSAM LLC.

7. Acceptable Use Policy

You agree not to use the Service to:

• Violate any local, state, national, or international law or regulation;
• Attempt to reverse-engineer, decompile, or extract the source code of the Service;
• Resell, sublicense, or distribute API access without prior written consent from INTERSAM LLC;
• Launch automated denial-of-service (DoS) attacks or circumvent rate limits;
• Crawl websites you are not authorized to test, or use the crawler against private or internal networks;
• Submit products through the Launch Package that are illegal, deceptive, adult, or that infringe third-party rights. We may decline any such order and refund it in full.

8. Limitation of Liability

To the maximum extent permitted by applicable law, INTERSAM LLC, its officers, directors, members, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill, resulting from your use of or inability to use the Service. In no event shall our total aggregate liability exceed the total amount paid by you to INTERSAM LLC in the twelve (12) months preceding the claim.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Any legal action or dispute arising out of these Terms shall be instituted exclusively in the state or federal courts located in Kansas City, Missouri.
